This document was drafted to be published as is, but must be updated once the legal entity and address are established.
Terms of Use
1. Acceptance
By accessing or using usecalendo.com and any pages, features, panels ("dashboard"), restricted areas, forms and resources made available (together, the "Service"), you declare that you have read, understood and agree to these Terms of Use ("Terms").
If you do not agree with any part of these Terms, do not use the Service.
Use of the Service is also subject to our Privacy Policy (LGPD), which describes how we process personal data, cookies and similar technologies. The Privacy Policy is part of these Terms for all purposes.
2. Definitions
For ease of reading:
- Calendo / We / Our: the service available at usecalendo.com and its responsible parties.
- User / You: any person who accesses or uses the Service.
- Account: credential and profile of the User for access to the dashboard/restricted area (when applicable).
- Content: any information, text, material, image, interface, layout, documentation and resources of the Service.
- User Content: comments, reviews, texts and any information published/submitted by Users within the Service.
- Third-Party Services: external tools and platforms integrated or accessed from the Service (for example, infrastructure providers, analytics, transactional email, social networks, booked services).
3. Scope of the service
Calendo may include, as made available from time to time:
- institutional and informational pages;
- newsletter and content;
- contact forms;
- client area/dashboards and account features;
- possibility to book third-party services (i.e., the Service may facilitate connection and booking, but the performance of the service may be by third parties);
- space for reviews/comments.
Calendo may be made available in Brazil and the United States. Some local rules may vary according to the User's country, but these Terms describe the minimum applicable to use of the Service.
4. Eligibility and account
4.1. Eligibility
You declare that you have legal capacity to accept these Terms. If you are a minor, you must use the Service with the knowledge and responsibility of your legal guardian.
4.2. Creation and use of account
Some features may require an Account. When creating or using an Account, you agree to:
- provide true and up-to-date information;
- maintain the confidentiality of your credentials;
- notify immediately in case of suspected unauthorized access;
- be responsible for activities carried out under your Account, to the extent permitted by law.
4.3. Corporate use
If you are using the Service on behalf of a company, you declare that you have authority to bind that company to these Terms.
5. User Content, comments and reviews
5.1. Responsibility for User Content
User Content is the sole responsibility of whoever publishes it. Calendo does not endorse, guarantee or take responsibility for User Content, except when required by law.
5.2. No prior moderation
Currently, there is no prior moderation. Nevertheless, we reserve the right (but not the obligation) to:
- remove, restrict, hide or edit User Content that violates these Terms, applicable laws, third-party rights, or that is abusive;
- investigate and take appropriate measures in case of reports.
5.3. Rules for comments and reviews
You agree not to publish User Content that:
- contains hate speech, harassment, threats, discrimination or incitement to violence;
- violates copyright, trademark, privacy, image or other third-party rights;
- contains personal data of third parties without legal basis/consent (e.g. phones, addresses, documents);
- is false, misleading, defamatory or fraudulent;
- includes spam, abusive self-promotion, malicious links or scripts.
5.4. License to use User Content
By publishing User Content, you grant Calendo a non-exclusive, worldwide, royalty-free license for the term of legal protection, to host, display, reproduce and make that content available within the Service and for related purposes (e.g. improvement, security, and presentation of the content itself where it was posted).
This does not transfer your ownership, it only allows the Service to function.
6. User conduct and prohibited uses
You agree to use the Service in an ethical and lawful manner. It is prohibited to:
- attempt to invade, take down, degrade or exploit vulnerabilities of the Service;
- perform scans, aggressive scraping, abusive automation, denial-of-service (DDoS) attacks or reverse-engineering attempts;
- interfere with security, authentication or integrity of the Service;
- use the Service for spam, phishing, malware, fraud or unlawful data collection;
- use Calendo's trademarks, identity or content improperly;
- circumvent cookie/privacy consent mechanisms.
We may adopt technical measures to prevent and respond to abuse, including blocks and access limitations.
7. Third-party services
The Service may integrate or direct to Third-Party Services (e.g. booked services, external tools, links).
In such cases:
- each third party may have its own terms and policies;
- we do not control the availability, quality, performance or practices of those third parties;
- the relationship between you and the third party is governed by that third party's instruments.
8. Intellectual property
Unless otherwise indicated, the Content of the Service, including trademark, layout, interfaces, texts, code and visual identity, is protected by intellectual property laws.
You may browse and use the Service for personal/professional purposes. You may not:
- copy, reproduce, modify, distribute or commercially exploit the Content of the Service without written authorization;
- remove intellectual property notices;
- use Calendo's trademarks and distinctive signs without permission.
There is third-party content on the Service (e.g. materials, references, integrations). Such content remains under the ownership of its respective owners.
9. Availability, disclaimers and limitation of liability
9.1. Availability
The Service may experience unavailability, maintenance, changes and interruptions. We seek to operate with stability, but do not guarantee uninterrupted operation.
9.2. Disclaimers
To the maximum extent permitted by law:
- the Service is provided "as is" and "as available";
- we do not guarantee that the Service will be free of defects, vulnerabilities or that it will meet all expectations;
- we do not guarantee specific results from use of the Service.
9.3. Limitation of liability
To the maximum extent permitted by law, Calendo shall not be liable for:
- indirect damages, loss of profits, loss of revenue, loss of data, business interruptions;
- acts of third parties, including providers and booked services;
- User Content published by third parties.
When the law does not allow exclusion of liability, the limitation shall apply to the maximum extent permitted.
10. Suspension and termination
We may suspend or terminate access/Account, temporarily or permanently, if:
- you violate these Terms;
- there are signs of fraud, abuse or risk to security;
- it is necessary to comply with a legal obligation.
You may request termination of your Account through the channel hello@usecalendo.com (and also exercise privacy rights in accordance with the Privacy Policy).
11. Changes to these Terms
We may update these Terms to reflect technical, legal or operational changes. The current version will be the one published on usecalendo.com, with update date.
If a change is material, we may communicate by email, notice on the Service or other reasonable means.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil, as applicable to the User and the Service.
The jurisdiction of the district of Porto Alegre/RS is elected, with waiver of any other, however privileged, to resolve disputes arising from these Terms, except mandatory legal rules to the contrary.
